Eden Prairie's permit rules center on whether your project creates a new opening at the curb. No permit is required for a driveway itself, including standard replacement with concrete, asphalt, or pavers. The trigger is a new curb cut at the street — and that requires a Right-of-Way/Utility Permit through the Engineering Division before work can begin.
The city's dimensional rules are precise and written into city code. Maximum driveway width is 30 feet at the curb. The driveway must be at least 3 feet from a side lot line and cannot cross the extension of a property line to the curb line. Approved surface materials are bituminous (asphalt), concrete, or pavers — crushed rock or stone is not a permitted driveway surface. Circular driveways with two street entrances are allowed provided there is no conflict at street intersections. There is typically 10 to 12 feet from the back of the curb to your lot line, which is the city's right-of-way; the city also recommends keeping the driveway out of any drainage and utility easement on your property because cable, electric, sewer, water, and gas lines may run through that area.
For a curb cut, plans for restoration must be approved by the city before work begins. Your submittal should include measurements from sidewalks or trails, curb and gutter, and street/right-of-way lines to the proposed work, plus a detailed plan for any traffic control or obstruction during construction. Any connection to city infrastructure requires 72 hours of advance notification to the Utilities Division at 952-949-8530. Allow five business days for permits to be processed; permit fees are due at the time the permit is issued and can be paid in person at the Engineering counter or by phone at 952-949-8330. If a pedestrian curb is altered as part of the work, the curb ramp must be restored to comply with ADA standards. Specific dollar amounts for curb cut fees are not published online — call the Engineering Division at 952-949-8407 to confirm the current 2025-2026 fee schedule before applying.
The penalty for skipping the permit is real. Failure to obtain a required permit is a violation of city ordinance and state law and fines may be levied. The building code also includes provisions allowing fees to be doubled if work begins prior to obtaining a permit.
