What to know about Columbia Heights permits

Columbia Heights only requires a permit when your driveway project touches the public curb. A simple resurfacing or replacement that stays in the same footprint and doesn't change the curb cut needs no city permit. The moment you move or widen the driveway in a way that alters the curb cut, however, you need a Work within Right-of-Way Permit through the Public Works Department. A joint or shared driveway with a neighbor is a separate, more involved process: it requires a Conditional Use Permit through Community Development, plus a recorded easement with Anoka County. If you're placing materials or a dumpster in the street while the work is happening, that's a third permit — a Street Obstruction Permit, which costs $30.

The driveway design rules are written into Chapter 9 of the city code. The maximum driveway slope is 6%, and crushed rock is not allowed as a surface — driveways and parking areas must be paved with a dustless all-weather hard surface (concrete, asphalt, or pavers). Setbacks depend on when your lot was platted: residential lots platted on or after May 29, 2001, or any lot wider than 60 feet, require a minimum 3-foot side-yard setback. Older, narrower lots have smaller setbacks under the legacy rule. Existing hard-surfaced driveways that don't meet current standards keep their legal nonconforming status until the surface is damaged, deteriorated, or replaced — at which point reconstruction must comply with current code. For non-residential properties (anything other than 1-to-4-family), all off-street parking and driveway areas must have 6-inch non-surmountable poured-in-place concrete perimeter curbing unless the city engineer waives it through an approved drainage plan.

The city does not process building permit applications online for driveway work. The process is print, complete, and call: download the application from columbiaheightsmn.gov, fill it out, then call 763-706-3670 to get the fee for your specific project (building permit fees are based on job valuation including materials and labor). Submit the completed form by email to inspections@columbiaheightsmn.gov, by mail with a check made payable to City of Columbia Heights to 590 40th Avenue NE, Columbia Heights, MN 55421, or in person at the same address. The in-person counter accepts cash, check, or credit card during regular business hours.

Work within Right-of-Way permits have an extra requirement: contractors must furnish a $5,000 Street and Public Easement Excavation Bond that stays in effect for two years for each excavation site, plus a current Certificate of Insurance, before the permit is released.
